OVI Company Membership Personal Data Processing Disclosure

In accordance with the Law No. 6698 on the Protection of Personal Data ("KVKK" or "Law") and related legislation, OVI Company ("OVI" or "Company"), located at [Your Company Address], as the Data Controller (Veri Sorumlusu), will process your personal data in the manner described below; your personal data will be recorded, stored, updated in compliance with the law and principles of honesty, may be disclosed to third parties when permitted by legislation and/or for the purpose of processing, classified, and processed in the ways specified in the KVKK.

1. Purpose of Processing Personal Data

Your personal data in the identity and communication categories, collected as a result of your registration on our website, such as name, surname, email, address, and phone information, is processed by the fundamental principles stipulated by the Law and within the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law. The purposes include:

  • Maintaining the membership relationship;
  • Offering special campaigns to members;
  • Conducting marketing activities through commercial electronic communication;
  • Customizing, presenting, and promoting products and services according to your needs and preferences;
  • Planning and executing processes for establishing and increasing loyalty to products or services;
  • Following up and analyzing business development projects related to our field of activity.

2. Method and Legal Basis for Collecting Your Personal Data

Personal data (identity and contact information) collected for website membership are obtained when you fill in the membership form on our website.

Your personal data is processed based on the legal grounds of the necessity to establish or perform a contract, directly related to your personal data as required by Article 5/2 (c) of the Law. This is necessary for establishing the membership agreement and ensuring your access to our products and services. Additionally, your personal data is processed based on our legitimate interests, provided that it does not violate your fundamental rights and freedoms, as required by Article 5/2 (f) of the Law, to protect our legitimate interests in potential consumer disputes. Furthermore, your personal data is processed based on the legal ground of establishing, exercising, or protecting a right, as required by Article 5/2 (e) of the Law.

3. Transfer of Personal Data

Your personal data may be transferred to public institutions and organizations as required by law, our service providers who assist in fulfilling our contractual obligations, and our partners for communication and marketing activities. The purpose of transferring the data aligns with the purpose of processing personal data. Additionally, your personal data may be transferred to our contracted transportation companies for the delivery of products, if applicable.

4. Application to the Data Controller and Your Rights

According to Article 11 of the Law, you have the right to apply to our company and:

  • Learn whether your personal data is being processed or not;
  • Request information if your personal data has been processed;
  • Learn the purpose of the processing and whether it is being used in accordance with its purpose;
  • Learn the recipients to whom your personal data is transferred domestically or internationally;
  • Request the correction of incomplete or inaccurate personal data;
  • Request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law;
  • Request notification of the operations performed as per subparagraphs (e) and (f) to third parties to whom your personal data has been transferred;
  • Object to the occurrence of a result against you arising from the analysis of your personal data solely by automated systems;

You can submit your information and application requests regarding your rights stated above to our Company as per the Communiqué on the Procedures and Principles of Application to the Data Controller through our Contact Us page.

Our Company shall fulfill your requests as soon as possible and within thirty days at the latest. However, fees may be charged for subsequent requests on the same issue or if the initial request requires performance of a transaction for an additional cost. Our Company may accept and process the request or may reject it by indicating the reasons in writing.

You are entitled to file a complaint to the Turkish Board of Personal Data Protection ("Board") within thirty days as of the notification of the reply and in all cases within sixty days if the application is rejected after carrying out the procedure mentioned above, the reply is deemed to be insufficient, or the requests are not responded to in a timely manner.
